POOL REVIVE CO
TERMS & CONDITIONS OF SERVICE

These Terms and Conditions apply to all quotations, estimates, invoices, works, services and agreements provided by Pool Revive Co ("Pool Revive Co", "we", "our", "us") and accepted by the customer ("Customer", "Client", "you", "your").
By accepting a quotation, paying a deposit, authorising work to commence, requesting services, or engaging Pool Revive Co in any manner, the Customer agrees to these Terms and Conditions.
1. SERVICES
Pool Revive Co provides services including but not limited to:
- Fibreglass pool resurfacing
- Fibreglass pool restoration
- Fibreglass pool repairs
- Structural fibreglass repairs
- Crack repairs
- Osmosis repairs
- Leak detection and diagnosis
- Surface preparation
- Topcoat and finish applications
- Green pool recovery
- Water balancing
- Commercial and accommodation pool restoration
- Related pool services
Pool Revive Co reserves the right to refuse or discontinue works where site conditions, safety concerns or circumstances make works unsafe, impractical or commercially unreasonable.
2. QUOTATIONS
All quotations:
- Are based on information available at the time of inspection.
- Are based on visible conditions only.
- Are valid for thirty (30) days unless otherwise stated.
- May be revised where site conditions change.
- May be revised if additional information becomes available.
Pool Revive Co reserves the right to amend or withdraw a quotation prior to acceptance.
3. ACCEPTANCE OF QUOTATION
A quotation is deemed accepted when:
- The customer signs acceptance;
- The customer provides written acceptance;
- The customer instructs Pool Revive Co to proceed;
- The customer pays a deposit.
Upon acceptance, a binding agreement exists between Pool Revive Co and the Customer.
4. DEPOSITS
A deposit is mandatory before works are scheduled, materials are ordered or services commence.
Unless otherwise agreed in writing:
- A 50% deposit is required.
- Works will not be scheduled until deposit funds have cleared.
- Materials will not be ordered until the deposit is received.
- Project commencement dates are not secured until the deposit is paid.
Payment of a deposit constitutes acceptance of these Terms and Conditions.
5. CANCELLATIONS AND REFUNDS
Change of Mind
Deposits are non-refundable in the event of a change of mind.
Cancellation Prior to Material Purchase
Where the Customer cancels after acceptance of the quotation but before materials have been purchased:
Pool Revive Co may refund up to 50% of the deposit.
The remaining deposit amount will be retained to cover:
- Administration costs
- Quoting costs
- Travel costs
- Scheduling costs
- Consultation time
- Business overheads
Cancellation After Materials Have Been Purchased
Once materials have been ordered, purchased, allocated, custom mixed or prepared for the project:
NO REFUND WILL BE PROVIDED.
The Customer acknowledges that project-specific materials may not be returnable and may result in financial loss to Pool Revive Co.
Cancellation After Work Commences
Where works have commenced, the Customer remains liable for:
- Labour performed
- Materials used
- Travel costs
- Accommodation costs
- Equipment costs
- Administration costs
- Any project expenses incurred
Any outstanding balance becomes immediately payable.
6. VARIATIONS
Any change requested by the Customer after acceptance of the quotation may constitute a variation.
Variations may result in:
- Additional charges
- Extended completion times
- Additional materials
- Additional labour
No variation work will proceed until approved by the Customer.
7. SITE ACCESS
The Customer must provide:
- Safe access
- Unrestricted access
- Suitable work area
- Access to electricity if required
- Access to water if required
Additional costs resulting from delayed or restricted access may be charged.
8. POOL DRAINING
Pool draining is NOT included within resurfacing or repair quotations unless specifically stated in writing.
Pool draining will be quoted separately.
The Customer is responsible for all costs associated with:
- Draining
- Pump hire
- Water disposal
- Groundwater management
- Refilling
- Water replacement
Pool Revive Co accepts no responsibility for water replacement costs.
9. GROUNDWATER AND HYDROSTATIC PRESSURE
The Customer acknowledges that groundwater pressure and hydrostatic pressure may impact drained pools.
Pool Revive Co shall not be responsible for:
- Pool movement
- Pool uplift
- Structural movement
- Groundwater conditions
- Existing site conditions
Where groundwater management is required, additional charges may apply.
10. HIDDEN DAMAGE
Pool Revive Co can only assess visible conditions during inspection.
Once the pool is drained and prepared, previously hidden defects may become visible including:
- Delamination
- Osmosis
- Water intrusion
- Fibreglass failure
- Structural cracking
- Previous repair failures
- Shell movement
Any additional repairs required will be quoted separately.
11. CUSTOMER DISCLOSURE
The Customer agrees to disclose any known:
- Structural issues
- Previous repairs
- Leak history
- Groundwater issues
- Pool movement
- Water loss concerns
Failure to disclose known issues may result in additional charges.
12. WEATHER DELAYS
Pool Revive Co is not responsible for delays caused by:
- Rain
- Wind
- Storms
- Humidity
- Extreme temperatures
- Environmental contamination
Completion dates are estimates only.
13. MATERIAL AVAILABILITY
Pool Revive Co shall not be liable for delays caused by:
- Supplier shortages
- Freight delays
- Material shortages
- Manufacturing delays
Project schedules may be adjusted accordingly.
14. COLOUR AND FINISH
The Customer acknowledges that final appearance may vary due to:
- Lighting
- Water depth
- Existing surfaces
- Manufacturing tolerances
- Environmental conditions
Minor colour variations and cosmetic differences are not defects.
15. WATER BALANCING
Where water balancing is included:
- It is provided at handover only.
- Ongoing maintenance remains the Customer's responsibility.
Pool Revive Co does not guarantee future water chemistry outcomes.
16. COMMERCIAL AND ACCOMMODATION CLIENTS
Commercial properties, resorts, accommodation facilities and holiday parks remain responsible for:
- Site access
- Operational shutdown requirements
- Public safety measures
- Guest communication
- Local authority compliance
Additional charges may apply where works must be staged or conducted outside normal operating conditions.
17. COMPLETION OF WORKS
Works are deemed complete when:
- Services described in the quotation have been completed; and
- The Customer has been notified.
Use of the pool constitutes acceptance of completed works.
18. PAYMENT TERMS
Unless otherwise agreed in writing:
- Deposit due before commencement.
- Final payment due immediately upon completion.
- Payment terms are seven (7) days from invoice date.
19. OVERDUE ACCOUNTS
The Customer agrees to pay all costs associated with recovery of unpaid amounts including:
- Debt collection costs
- Legal costs
- Administrative costs
- Collection agency fees
20. PHOTOGRAPHY AND MARKETING
Pool Revive Co may photograph and record:
- Before works
- During works
- Completed works
Images may be used for:
- Website content
- Marketing
- Social media
- Training
- Portfolio purposes
No personal information will be published without consent.
21. WARRANTY
Any workmanship warranty applies only to work performed by Pool Revive Co.
Warranty does not cover damage caused by:
- Ground movement
- Hydrostatic pressure
- Structural movement
- Chemical imbalance
- Lack of maintenance
- Third-party repairs
- Natural disasters
- Flooding
- Misuse
Product-specific warranties remain subject to manufacturer conditions.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Pool Revive Co shall not be liable for:
- Indirect loss
- Consequential loss
- Loss of profit
- Loss of business income
- Loss of opportunity
- Delays outside our control
Liability is limited to the value of services supplied.
23. FORCE MAJEURE
Pool Revive Co shall not be liable for delays or failure to perform resulting from events beyond reasonable control including:
- Natural disasters
- Flooding
- Severe weather
- Government restrictions
- Industrial action
- Supplier failures
- Transport disruptions
24. GOVERNING LAW
These Terms and Conditions are governed by the laws of Western Australia.
Any dispute shall be subject to the jurisdiction of the courts of Western Australia.
25. ENTIRE AGREEMENT
These Terms and Conditions, together with any quotation, invoice or written agreement, constitute the entire agreement between Pool Revive Co and the Customer.
No verbal statement shall override these Terms and Conditions unless confirmed in writing by Pool Revive Co.
By accepting a quotation, paying a deposit or authorising Pool Revive Co to proceed, the Customer acknowledges that they have read, understood and accepted these Terms and Conditions.
